Guidance on resolvability

At the beginning of 2022, the European Banking Authority (EBA) published guidelines on improving resolvability for institutions and resolution authorities. As Sweden’s resolution authority, the Debt Office has put together a memorandum describing the purpose, scope, and legal status of the guidelines. The Debt Office has also created a guidance document to help Swedish banks understand how the guidelines should be interpreted and applied.

The EBA’s guidelines introduce an EU-common minimum standard for resolvability within a number of areas, which is mainly directed at systemically important banks. The Debt Office’s preliminary assessment is that the agency intends to comply with these guidelines. Accordingly, the Swedish systemically important banks are to presume that they should comply with the guidelines.

The guidelines are extensive and enter into force on 1 January 2024. It is therefore important for the banks to initiate the compliance process now.

In this document, the Debt Office describes the EBA guidelines’ legal status, their implications for banks, and how they will be applied by the Debt Office as an integral part of the resolution planning process.

To facilitate this, the Debt Office has put together a guidance document for how certain parts of the guidelines are to be interpreted and implemented by the Swedish banks. The guidance also specifies the parts of the guidelines for which the banks should self-assess their compliance as well as what additional information the Debt Office will be collecting until 1 January 2024. We will inform each bank separately about how the self-assessments are to be conducted and how the additional information will be obtained. The guidance document will be supplemented and updated as necessary.

The Debt Office’s implementation of the bail-in tool

This report presents how the Debt Office plans to implement the bail-in tool. It describes the basic premises for implementation and also the measures that the Debt Office, the institution (bank) in resolution, and other relevant actors may take. The Debt Office will continue to develop the report, and make any necessary adjustments, as its analysis and work progress.
